You should not send any message, including comments and reviews, to our website if you do not agree to these terms and conditions (and later amendments).
We evaluate all comments before they are posted and will not post any that violate our commenting policy. Before posting comments, we may moderate them to remove connections to commercial websites or personal information.
Rights and Expectations
Grant of a license. By submitting any communication to our site, you grant IRAEmpire.com an irrevocable, non-exclusive, worldwide, perpetual, unrestricted, royalty-free license (with the right to sublicense) to use, reproduce, distribute, publicly display, publicly perform, modify, edit, create derivative works from, and otherwise exploit such communications, as well as any personal information transmitted with your communications (such as your name, user name, and photograph), in all formats.
The right to use. In addition to the rights granted above, by submitting reviews to the site, you hereby grant IRAEmpire.com the right to use the user name, identifier, or any portion thereof, and any photograph submitted or otherwise transmitted in connection with such reviews on the site, if IRAEmpire.com so desires.
Rights waiver. You hereby waive all rights sometimes referred to as “moral rights” in your communications, to the extent that they can be waived under any existing or future legislation of any jurisdiction. Content Monitoring and Restrictions
Monitoring. IRAEmpire.com reserves the right, but has no obligation, to monitor the site tools and edit, modify, or delete any communications or portions thereof that it deems inappropriate, offensive, or contrary to any IRAEmpire.com policy, or that violate this agreement, in its sole discretion.
Communications are prohibited. You agree not to upload, distribute, or otherwise publish any communication to or through the site or its tools that:
- Is commercial in nature or otherwise advertises or solicits the sale of products or services, such as sales pitches or promotions;
- Is vulgar, indecent, pornographic, profane, sexually explicit, offensive, threatening, or abusive, or specifically targets certain groups;
- consists of or contains false or misleading origin indications or claims of fact (obviously misleading or false information);
- Slanders, libels, defames, disparages, or otherwise breaches any third party’s legal rights;
- Causes bodily harm to any person or entity;
- Infringes or breaches any third party’s intellectual property rights (including copyright, patent, and trademark rights), contract rights, trade secrets, privacy or publicity rights, or any other rights;
- Any law, rule, or regulation is broken;
- Contains software viruses or other malicious code that is intended to disrupt, destroy, or limit the performance of any computer software, hardware, or telecommunications equipment;
- Impersonates another person or entity, or gathers or uses any information regarding IRAEmpire.com visitors; or
- Personal information such as names, addresses, or other sensitive information about an individual, including the person who posted the comment.
Agreement to refrain from posting. When you submit comments on the IRAEmpire.com website or use any of its features, you agree not to:
- Attempt to conceal the source of any transmitted content;
- Act in any way that may impair the capacity of other users to utilize the site;
- Impersonate anybody or anything, including the owner of a product or service, or fraudulently assert or otherwise misrepresent your association with someone or something. or
- Upload, publish, or otherwise distribute any content that:
- Is not relevant to the product, service, person, or entity being reviewed or rated
- Is not based on personal, first-hand experience or knowledge of the product or service you are commenting on or about
- You do not have a right to transmit under any law or contractual or fiduciary relationships (such as inside information, copyright material, proprietary and confidential information learned or disclosed as part of an employment relationship or under a no-compete clause).
Your Guarantees and Representations. You also represent and warrant that (i) the reviews you submit are original to you and based on personal experience, (ii) such reviews do not violate or breach any of the terms of this agreement, and (iii) IRAEmpire.com will not be required to pay or incur any sums to any person or entity as a result of its use or exploitation of the comment or review.
Content Moderation
Function that modifies. IRAEmpire.com reserves the right to take any or no action with regard to comments or reviews provided to the site, including, but not limited to, deleting, editing, amending, rejecting, or refusing to post such reviews without notice and at its sole discretion. IRAEmpire.com may attribute authorship of communications to you by using your first name, geographical location, or other identifier. If requested by a court or law enforcement agency, IRAEmpire.com maintains the right to submit information from comments to appropriate government entities.
Rights Reservation. IRAEmpire.com reserves the right to (i) screen communications for errors, profanity, indecency, mistakes, relevancy, and potential violation of third-party personal or proprietary rights (such as infringement of intellectual property rights, defamation, and so on); and (ii) edit, modify, remove, or disable access to any content that violates these provisions or that IRAEmpire.com deems objectionable. Without limiting the foregoing, IRAEmpire.com reserves the right to report any activity or persons (including the disclosure of appropriate user information) that IRAEmpire.com suspects has violated any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. IRAEmpire.com may also work with law enforcement to aid in the investigation and prosecution of any illegal activity.
